Personal Injury Litigation Experience
Simon has worked on many high profile cases, including Wynn v GIO, a Compensation matter which remains a precedent for the proposition that a deduction of 15% should not automatically be used to calculate the ups and downs of a person’s life or fortunes, and that a female plaintiff should not be penalised (by reason of the fact that had she remained in employment she would have incurred substantial childcare expenses) in terms of a claim for future economic loss.
Defamation and other Litigation Experience
Outside of Compensation, Simon has a specific interest in defamation and has worked on numerous high profile cases, acting against all of the major media companies in Australia. His media law interests extend to Copyright and Intellectual Property Infringement, and he was the solicitor for the Applicant in Meskanas v ACP Publishing, an Intellectual Property matter which remains the only reported decision on an artist’s moral rights in Australia. He has also acted in numerous commercial and equity cases in the District, Supreme and Federal Courts.
Outside of Work
Since moving to Newcastle four years ago, Simon is involved in the local community through his membership of the Waratah Golf Club, and is a regular Saturday morning golfer. With a keen interest in rugby league football, he supports the Newcastle Knights and the Newtown Jets, and enjoys films (the classics), theatre, live music, crime fiction, military history, Valiant motor cars, spicy food and “bad dancing”.
