PERSONAL INJURY TIME LIMITS

Current personal injury laws around Australia detail that strict time limits apply to motor vehicle accident claims if you are a driver of a motor vehicle, the passenger, cyclist or a pedestrian. It is for this reason it is vital to obtain personal injury legal advice as soon as possible from a qualified personal injury compensation specialist who will ensure that you gain the maximum possible compensation you are entitled to.

One of these time limits is the time you take to report your accident to the police. Currently, you have 24 hours in which to report your motor vehicle accident to the police. If you fail to do so, you may have to go to court and prove that sufficient cause existed to justify the report delay. Once this process is completed, you will receive an “event” number as a record of the notification of the accident.

The Accident Notification Form must be lodged within 6 months from the date of the accident.

The Accident Notification Form can be refused if it is lodged after the 6 month period. If you are able to justify the delay with a full and satisfactory explanation to the insurer, you may still be able to make a claim.

A claim cannot and will not be accepted if it is lodged later than 3 years after the date of the motor vehicle accident.

Compensation for minor injuries arising from motor vehicle accidents

There are a number of circumstances in which you may be able to claim personal injury compensation for if you have sustained personal injury in a motor vehicle accident. If your claim is up to $5000 (which covers medical expenses) then complete and lodge an Accident Notification Form which you can download from here.


If you have sustained only minor injuries in a motor vehicle accident, you generally do not need to engage a personal injury compensation lawyer to make a claim.
