Current Compensation Laws around Australia detail that strict time limits apply to Motor Vehicle Incident claims if you are a driver of a motor vehicle, the passenger, cyclist or a pedestrian. It is for this reason it is vital to obtain personal incident legal advice as soon as possible from a qualified personal incident compensation specialist who will ensure that you gain the maximum possible compensation you are entitled to.

One of these time limits is the time you take to report your incident to the police. Currently, you have 24 hours in which to report your Motor Vehicle Incident to the police. If you fail to do so, you may have to go to court and prove that sufficient cause existed to justify the report delay. Once this process is completed, you will receive an “event” number as a record of the notification of the incident.

The incident Notification Form must be lodged within 6 months from the date of the incident.

The incident Notification Form can be refused if it is lodged after the 6 month period. If you are able to justify the delay with a full and satisfactory explanation to the insurer, you may still be able to make a claim.

A claim cannot and will not be accepted if it is lodged later than 3 years after the date of the Motor Vehicle Incident.

Compensation for minor injuries arising from Motor Vehicle Incidents
